Sean Penn’s Divorce Proceeding Begins

In another story of failed Hollywood marriage, actor/actress couple Sean and Robin Wright Penn have filed for divorce.

The couple has been separated since November 30th, according to official court paperwork. Initially, the Mystic River actor filed for divorce on December 7th, but the petition was later dismissed.

Then, on December 21st, Robin filed her own paperwork. Both accounts cite “irreconcilable differences” as the reason for their dissolution, and request joint legal and physical custody of their two kids Dylan Frances (16) and Hopper Jack (14).

From here, they must wait until their hearing, set for April 21st. Sean and Robin Wright Penn have been married since April of 1996.


Miley Cyrus and Nick Jonas Call It Quits

Teen sensation Miley Cyrus keeps chugging along on her Best Of Both Worlds tour, playing the second of a two-day stint at the Prudential Center in Newark, NJ tonight (December 30).

Carrying her puppy, the Hannah Montana singer/actress was spotted leaving her hotel to head to the arena earlier today, followed close behind by her opening act, the Jonas Brothers.

Big news on tour centers around the relationship between Miley and Nick Jonas - who have reportedly broken off a relationship which began at the beginning of the tour.

A source told the NY Post, “They just broke up, but not many people even knew they were going out.”

Meanwhile, as expected, a spokesman for Cyrus didn’t offer any info, simply saying, “We do not comment on our client’s personal life.”

K-Fed’s Lawyer Grows Impatient with Britney Spears

Given her tendency to blow off her deposition dates, Britney Spears is gaining a reputation for stalling her custody case with Kevin Federline. But that’s all about to change.

The “Piece of Me” singer missed her most recent court-ordered deposition on December 12th because she claimed she was too ill to show up. But the fact that she was photographed partying later that night has caused K-Fed’s lawyer, Mark Vincent Kaplan, to toughen up on her.
Kaplan told press, “Britney Spears will have her deposition early (next) year. We’ve got a lot to talk about.”

Regarding Spears’ playing hooky, Kaplan said, “She was, in fact, out later that day and night. It’s not fourth grade where you get a doctor’s note and it’s all OK.”

Despite her apparent desperation to regain custody of Jayden James and Sean Preston, Brit hasn’t done anything to help the custody battle move along swiftly. You gotta wonder if she’s afraid that her deposition will be a detriment to her case.

Jamie Lynn Spears’ Pregnancy: Is It Legal?

The announced pregnancy of Jamie Lynn Spears, the 16-year-old sister of Britney Spears and the star of Nickelodeon’s “Zoey 101,” opens up a wide range of complicated legal questions. Given Spears’ status as a minor, what does that mean for longtime boyfriend Casey Aldridge, whom Spears reportedly met while attending church services? Depending on a number of factors, it could mean jail time for Aldridge — who, depending on the source, is either 17, 18, or 19 — but only if Spears’ family decides to press charges, which, judging by the public statements made by press time, appears unlikely.

(At press time, MTV News was unable to confirm Aldridge’s age definitively: Many reports — including that of OK! magazine, which broke the story — say he’s 18, some say 19, his MySpace page says 17.)

Ultimately, the first question for investigators would be the “venue,” or the state in which the baby was conceived. Without that information, no criminal proceedings can be initiated. According to the penal codes of the three states where Aldridge and Spears, who turned 16 in April, were most likely to have conceived the child — California, where “Zoey 101″ is taped; Louisiana, where Spears lives when the show is between seasons, and where she has said she intends to raise her child; and Mississippi, where Aldridge resides — Aldridge’s paternity could potentially give rise to criminal charges.

According to the FBI’s definition, statutory rape is characterized as non-forcible sexual intercourse with a person who is younger than the statutory age of consent in each respective state. The actual ages for these laws vary greatly from state-to-state, as do the punishments for the alleged offenders. Many states do not use the term “statutory rape,” simply calling it “rape” or “unlawful sexual penetration,” among a variety of other titles. One such state is Mississippi, where the crime is called “having carnal knowledge of a child.”

MTV News consulted three legal experts — Father Lawrence Moore, associate dean of academic affairs for Loyola University’s College of Law in New Orleans; University of Mississippi School of Law professor Philip Broadhead; and Sandi Gibbons, a spokeswoman for the Los Angeles County district attorney’s office — who noted that these laws apply to any type of sexual contact. Dating someone without sexual contact cannot be considered a form of statutory rape, and is almost never illegal in any state. All states have an “age of consent,” or the age at which a person can legally consent to sexual activity and can then no longer be a victim of statutory rape.

Some states will make exceptions when the older person is also young or of a similar age, or if they marry the minor before the act of sexual intercourse or before being charged with the offense. These laws presume coercion, because a minor is legally incapable of giving consent to a sexual act.

In some states, criminal proceedings against an offender cannot be initiated unless the offended person’s family presses charges. Assuming the couple are in good standing, Aldridge is probably in the clear. However, several online reports have crept up in the wake of Spears’ announcement Tuesday night, claiming the couple’s relationship was over; they cite Aldridge’s alleged MySpace page, the headline of which reads “Me and Jamie Are Over :(.” If the couple have indeed split up and the parting was less than amicable, Spears and her parents could file a formal complaint, which would set the legal wheels in motion.

In Louisiana, the age of consensual sexual intercourse is 17. The state’s statutory-rape law goes into effect if the offender is 19 or older and has had sexual relations with a minor between ages 12 and 17; such offenses are considered felony crimes.

There’s also a misdemeanor version of the law, which states that if the offender is between ages 17 and 19, and has sexual relations with a person who is between ages 15 and 17 with the difference in both participants’ ages being at least two years, the offender could be charged with misdemeanor carnal knowledge of a juvenile. Those convicted face up to 10 years behind bars, with or without hard labor.

The New York Post quoted Deputy Sheriff Jimmy Travis of Tangipahoa Parish, Louisiana, where the Spears family lives as saying that the couple broke no state laws if the child was conceived in Louisiana.

“From my preliminary investigation, she is 16 and he is 18,” he said. “If, in fact, it happened in the state of Louisiana, that does not violate any criminal statutes.” However, if Aldridge was 19 at the time of conception, there could be a case.

In Mississippi, the age of consent is 16 and the sentence for carnal knowledge of a minor is up to five years in jail, in addition to a $5,000 fine. This offense is committed when a person who is 17 or older engages in sexual intercourse with a minor who is at least 14 but under age 16; however, if the victim is less than 36 months younger than the offender, then no crime has been committed.

According to University of Mississippi School of Law professor Philip Broadhead, the state amended the sexual battery and rape statutes six years ago, raising the age of consent from 14 to 16.

“There are exceptions to the law,” he said. “For instance, a 17-year-old has sex with his 14-year-old girlfriend — they put age ranges into the statute to lessen the penalties and in some cases do away with the penalties altogether. The bottom line is, the Mississippi legislature raised the age of consent to 16. [However,] if a 16-year-old girl has a 19-year-old partner, that’s statutory rape — absolutely.

“The venue would be important as to what specific law applies, of course, but proving that would be difficult, because [Spears may not] cooperate and he has a right to remain silent,” he continued. “Jurisdiction and venue are the first things you need to answer. If you can’t, there’s no going forward.”

California’s penal code is comparatively simple. It puts the age of consent at 18, and defines unlawful sexual intercourse as “an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor.” The crime is a misdemeanor if the offender is less than three years older or three years older than the victim; someone more than three years older could be charged with a felony.

Sandi Gibbons, a spokeswoman for the Los Angeles County district attorney’s office, said a person is considered an adult in California when they turn 18. She wouldn’t speculate as to Aldridge’s criminal culpability, reiterating what Broadhead said about the site of the alleged offense.

“It doesn’t make any difference if [Spears] works [in California], it’s where the sex occurred,” she said. “I don’t know where the child was conceived and I’m not sure what the circumstances are. The law is clear.”

Jamie Lynn Spears, Britney’s Sister, Is Pregnant

Jamie Lynn Spears, Britney’s sister, is pregnant, the 16-year-old told OK! magazine. The father is her longtime boyfriend, Casey Aldridge, she said. “It was a shock for both of us, so unexpected,” Jamie Lynn Spears, who is 12 weeks along in her pregnancy, told the magazine for its new issue, which hits stands this week.

“I was in complete and total shock, and so was he,” she said. “As soon as I found out for sure from the doctor, I took two weeks to myself where I didn’t tell anybody. Only one of my friends knew because I needed to work out what I would do for myself before I let anyone’s opinion affect my decision. Then I told my parents and my friends. I was scared, but I had to do what was right for me.”

According to the interview, Jamie Lynn confirmed the pregnancy through a home test. She later paid a visit to the doctor, who corroborated the news. She said she revealed the news to her parents shortly before Thanksgiving.

Jamie Lynn said that her mother, Lynne Spears, “was very upset because it wasn’t what she expected at all. A week after, she had time to cope with it and became very supportive.” Lynne Spears also commented on the news, saying, “I didn’t believe it because Jamie Lynn’s always been so conscientious. She’s never late for her curfew. I was in shock. I mean, this is my 16-year-old baby.”

Jamie Lynn, a high school junior, reportedly plans to raise the baby in Louisiana, her home state, “so it can have a normal family life.” In regards to the third season of her Nickelodeon show, “Zoey 101,” which wraps January 4, Jamie Lynn said: “I haven’t spoken to [Nickelodeon] personally, but they have always been so great to me over the past years and have given me so many opportunities.” The show is slated to start back up again in February, and fourth-season filming is already done.

Nickelodeon issued a statement Tuesday afternoon, saying, “We respect Jamie Lynn’s decision to take responsibility in this sensitive and personal situation. We know this is a very difficult time for her and her family, and our primary concern right now is for Jamie Lynn’s well being.”

When the magazine reportedly asked her about the message her pregnancy might send to young people, she replied, “I definitely don’t think it’s something you should do; it’s better to wait. But I can’t be judgmental because it’s a position I put myself in.”

Lynne Spears told OK! that her daughter had been dating Casey Aldridge for years. But in an Associated Press interview conducted shortly before Thanksgiving, Jamie Lynn said she did not have a steady boyfriend. “I kind of just keep my options open,” she told AP. “I have a bunch of friends that I always hang out with, a bunch of guy friends.” In the OK! interview, Jamie Lynn said she had met Aldridge at church.

Aldridge’s mother, Joyce, spoke with TMZ about the pregnancy, saying, “We are aware of the recent interview regarding her and being pregnant, and we are in agreement with everything that was said by Jamie Lynn about the situation … everything is fine. … Casey will address all of this when it is time.”

Also yet to be addressed is whether Jamie Lynn and Casey plan to marry. His uncle, Odus Jackson — who is a Baptist pastor — said in an interview with People outside his nephew’s house in Mississippi, “They may or may not [get married]. You just never know.” He added, “I hope they will stick it out and get married for the child’s sake and their sake. But if they’re not in love and it was just a fantasy, they don’t need to make the same mistake twice.”

According to a video posted on TMZ.com, Britney appeared not to be aware of the Jamie Lynn news before it broke wide, telling reporters during a shopping spree Tuesday night, “My sister’s not pregnant!” But on Wednesday, the site ran a report in which a source said the singer was just being sarcastic.

Lindsay Lohan — I Need Hannah Montana Tickets!

Lindsay Lohan pimped herself out on a Las Vegas radio station this morning, using her celebrity to try and get Hannah Montana tickets for a friend’s kids. Freaky Friday!

The legally blonde rehabbed 21-year-old placed the call to the “Mark and Mercedes in the Morning” show on KMXB radio this morning, hoping to score … tix to the hottest concert of the the year. Don’t leave her around Miley unchaperoned! Mark and Mercedes were able to keep La Lohan on the line for over five minutes … dishing out the goods. Confessions!

Britney Spears Ditches Deposition

Britney Spears was going to be giving a deposition in her custody case with Kevin Federline. But it seems that she was too sick to show up.

The official story is that the “Gimme More” singer was unable to attend the court proceeding due to “an illness.” According to K-Fed’s lawyer, Mark Vincent Kaplan, “I was told of a general [medical] condition, and [Spears] felt she couldn’t attend.”

Brit’s pal Sam Lufti corroborated her story. “She’s sick, both physically and high anxiety. Millions of press outside. It’s too much.”

The court set a new date for the deposition, and Kaplan says he will pursue a sanction to insure that the “Lucky” singer shows up.

The new deposition date has not been released.

2008 Grammy Nominees Announced

It would appear that personal turmoil equals Grammy nods this year. At least that’s the case for Kanye West and Amy Winehouse. Between his mother dying and her husband being thrown in the slammer, these two were pretty desperate for some good news.

Between the two of them, the “Jesus Walks” rapper and the “Rehab” singer have a total of fourteen nominations (8 for him, 6 for her). And they’re not the only ones with multiple chances to take home an award.

On the next tier down, there were four artists with 5 nominations each: Jay-Z, Justin Timberlake, T-Pain, and Foo Fighters. And Akon, Dierks Bentley, Feist, Chris Daughtry, Tim McGraw, Rihanna, Ne-Yo, Bruce Springsteen, and John Newton all have four chances.
